myaouchie terms of service for clients !

1. you own this art for personal use, and only if agreed upon (for example, twitch emotes, company logos etc) you can use the art and/or the design for commercial use. however, this does not apply to merch, please discuss plans to use my art on merch seperately and expect to pay extra for the rights to use it for sale. you may use the artwork for branding (emotes, banners, panels, profile pictures) but cannot reproduce it commercially (merchandise such as apparel, stickers, etc) unless agreed to beforehand.1b. for twitch emotes, these commissions are individual to you and your brand only. i will not sell these to other people (at the time of writing, i do not sell P2U emotes. all emotes are commission only for the usage of the commissioner+their branding only.)2. i reserve the right to cancel or decline any commission- if you request a cancellation for a piece that is past the sketching phase, you will pay a proportional amount to the work done.2b. i do not do NSFW/mechas (with some exceptions, please discuss if needed)/hateful content and i have the right to decline anything that makes me uncomfortable. i will inform you if a request makes me uncomfortable before starting it, and if for whatever reason i begin a commission and cannot complete it, i will refund the appropriate amount or discuss possible workarounds with you.3. if you need changes made to the artwork, please let me know, even if it's after the piece is completed, i'm happy to see what i can do! do not trace the artwork, and do not alter it for public usage without permission or informing me beforehand. i'm happy to send files for clients i trust for them to alter them appropriately for their needs- just inform me beforehand where possible.4. for commercial use items (social media icons, veadotube avatars, twitch emotes- anything that’ll publicly be seen and used often) i request credit where possible. i suggest for streamers to put this either in an ‘!emote’ command, or ideally in their ‘about’ section on twitch, crediting emotes to ‘Myaouchie.’ links are not needed, but appreciated- please ask if you’re unsure what link/text to put. for social media icons i suggest a @ in your bio/about me, or a story highlight that directs to one of my links; again, please ask if you’re unsure what to put and wish to credit me in writing.4b. if this REALLY does not fit with your branding, you still cannot claim this art/design as your own! please credit me wherever possible, even just by saying ‘mya made this!' and clarifying if people don't already know that i can be found by 'Myaouchie' online when asked. it helps me a lot as i want to have a career in illustration, and i'm not super well known; if i made you happy with my work, please consider crediting me appropriately! thank you for understanding.please credit me in writing where possible- support your local artists! but it isn’t REQUIRED. just credit me when talking about the art or asked about it.MY WORK WILL NOT BE USED FOR AI/NFT/BLOCKCHAIN ETC. USING MY ART FOR THIS WITHOUT PERMISSION MAY RESULT IN LEGAL ACTION TAKEN.BY COMMISSIONING ME, YOU ARE AGREEING TO MY TERMS AND CONDITIONS, WHICH ARE SUBJECT TO UPDATE AND CHANGE. YOU WILL BE INFORMED OF ANY MAJOR CHANGES IF THEY’LL IMPACT YOU, OR THE WORK YOU HAVE PAYED ME FOR.

payment is through ko-fi most times, but i will send you the link when it's time for payment to avoid confusion.my prices are in GBP, but i'm happy to convert this for the client!depending on the commission type and the client, i may request payment beforehand. if i don't, you will still be expected to pay in full at an agreed time.if you need the art by a specific deadline please discuss it with me. i'll update you on the process either way, but understand i have a chronic illness and therefore i have limits, i need to be informed about deadlines ASAP.i can use the art to:
- promote myself for advertising purposes.
- display on any form of social media i am on, unless agreed otherwise.
- use as examples to others, with the watermark attached (with credit to the client for any original designs they suggested, e.g. D&D characters)
you can:
claim rights to the character/design, but not the drawing itself.
share/repost their artwork any place you see fit with proper credit to the artist where possible.
request that their art piece not be displayed on other platforms by the artist.
please be kind, clear, and communicative when talking to ANY artist. it's okay if you have a specific vision in mind- i'll do everything i can to reach this vision with you, but understand artists are human too, and we're all doing our best! thank you for reading!

commission process !

- we discuss what u want, pls provide references (photos, sketches, descriptions) of what you want the final product to be like! if you're not too bothered and want to give me full freedom with a brief description, that works too, but any changes will have to be made before i start linework (e.g. when i send the final sketch will be ur opportunity to change things)- i receive payment once we're on the same page, this can be per item, or all in one go
if it's per item, i will not start the next item without payment
if it's all in one go, i will start them at my own pace and update you throughout the process normally
- i send you sketches, a final sketch, linework+base colours, and then the final image
i will only send other updates if requested, or if i feel necessary/wish to ask you something about the piece!
